Abstract

Circumstances, which are subject to substantiation, are one of the basic elements in methods of inquiry of the crimes against public order. The subject of substantiation should be considered as a complex of evidential information and as a distinctive orientation point in studying the circumstances of a criminal case. It’s impossible to designate the exhaustive list of circumstances being subject to substantiation for each criminal case, because of the individuality and unique character of each case being inspected, and their specific features. The subject of substantiation is greatly influenced by the investigative situation under conditions of which the inquiry is being conducted, and which should be differentiated depending on the availability of the infonnation about a criminal. The subject of substantiation in the crimes against public order has its general and individual features.
